By downloading, installing, or using Essentia ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Essentia ("we," "us," or "our") regarding your use of the App.

Essentia is a personal health and wellness tracking application that allows users to:

Your privacy is important to us. All data you enter into Essentia is stored locally on your device:

• • All tracking data remains on your device under your control

6. Apple Health Integration

The App integrates with Apple Health (HealthKit) to read step count data:

• • Access to Health data requires your explicit permission
• • You can revoke Health access at any time through iOS Settings
• • We only read the data you authorize and do not write data to Health
• • Health data is processed locally on your device and never transmitted externally
• • We comply with Apple's HealthKit Review Guidelines

7. Intellectual Property

The App, including all content, features, and functionality, is owned by Essentia and is protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• • The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• • We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement
• • We are not liable for any indirect, incidental, special, consequential, or punitive damages
• • We are not responsible for any health outcomes, injuries, or damages resulting from use of the App
• • We are not liable for data loss, device malfunction, or any technical issues
• • Our total liability shall not exceed the amount you paid for the App (which is currently free)

9. Indemnification

You agree to indemnify, defend, and hold harmless Essentia and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App or violation of these Terms.

10. Age Restrictions

The App is intended for users who are at least 13 years of age. If you are under 13, you may only use the App with the involvement and consent of a parent or legal guardian. Users under 18 should review these Terms with a parent or guardian.

11. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the revised Terms.

13. Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice.

Upon termination, all rights granted to you under these Terms will immediately cease, and you must stop all use of the App.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions. Any disputes arising from these Terms or use of the App shall be resolved in the courts of competent jurisdiction in your location.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Essentia regarding the use of the App and supersede all prior agreements and understandings.
